These Terms of Use ("Terms") govern your access to and use of Pockét Eye / PokEYE ("PokEYE," "we," "us," or "our") — an independent iPhone app and service (together, the "Service") for scanning, identifying, pricing, and tracking physical Pokémon trading cards. By downloading or using PokEYE, you agree to these Terms. If you do not agree, please do not use the Service.
PokEYE uses your device's camera and related software to identify physical trading cards, organize your collection, and display estimated market information — such as pricing, price history, graded-population statistics, and collection value — collected from public marketplace and grading sources. Identification and pricing may be wrong, incomplete, delayed, or unavailable.
PokEYE is intended for users who are at least 13 years old. Do not use PokEYE if you are under 13. If you are 13 or older but under the age of majority where you live, you may use PokEYE only with permission and supervision from a parent or legal guardian, and purchases may require their approval. We may request age confirmation and may suspend or delete an account if we reasonably believe it is used by a person under 13 or without required consent. Apple purchase-approval tools such as Family Sharing "Ask to Buy" and Screen Time are controlled by Apple.
You may use some features without an account. Account-based features use Sign in with Apple. You are responsible for keeping your device and Apple account secure and for activity on your account. You can delete your PokEYE account at any time from within the app (in the app's Settings), which removes your server-side account data as described in our Privacy Policy.
Deleting your PokEYE account, deleting the app, or uninstalling the app does not cancel an active Apple subscription. Subscriptions are billed by Apple and must be cancelled in your App Store subscription settings (see below).
Some features — such as price-history charts, PSA population data, sales history, market trends, collection insights, and unlimited collection size — require a paid PokEYE Pro subscription. PokEYE Pro is an auto-renewable subscription sold only through Apple in-app purchase.
Nothing in these Terms limits non-waivable consumer rights that apply where you live.
If you start a free trial, Apple will not charge the subscription price until the trial ends, unless Apple's purchase sheet says otherwise. At the end of the trial, the subscription automatically renews as a paid subscription unless you cancel before the deadline shown by Apple. Eligibility for free trials is controlled by Apple and may be limited (for example, to one trial per Apple Account).
The free tier includes generous but limited usage — for example, a maximum collection size and a daily allowance of price lookups. These limits exist to keep the Service fast and sustainable, and we may adjust them over time. We may throttle or refuse requests that exceed limits or that appear automated or abusive.
If you are located in the European Economic Area or the United Kingdom, you may have statutory rights to receive pre-contract information and, in some cases, to withdraw from a distance contract for digital services. Because PokEYE Pro provides immediate access to digital features, any legally required consent and acknowledgment is obtained through Apple's purchase flow before access begins, or the applicable withdrawal period is otherwise honored. Refund and cancellation requests for Apple in-app purchases must be submitted through Apple, but you may also contact us at support@pocketeye.app if you believe your statutory rights are not being honored.
Pricing, price-history, graded-population, and collection-value information shown in PokEYE is informational only. It is derived from public market data, such as marketplace sold listings and published population reports, and may be incomplete, delayed, estimated, or wrong; markets move, sources contain errors, and an individual card's condition, printing, or grading can change its value substantially. PokEYE is not an appraisal service, financial adviser, broker, marketplace, grading company, or insurer. You should not rely on PokEYE as the sole basis for purchase, sale, insurance, tax, investment, or grading decisions. Third-party marketplace and grading data remain subject to the applicable source terms and may change or be removed.
Pokémon, Pokémon TCG, card names, set names, artwork, character names, logos, and related marks are owned by Nintendo, Creatures Inc., GAME FREAK Inc., The Pokémon Company, and/or The Pokémon Company International. PokEYE is an independent collector tool and is not affiliated with, sponsored by, endorsed by, approved by, or associated with those companies. References to Pokémon cards, card names, set names, card numbers, and related marks are used only as reasonably necessary to identify the physical trading cards that users scan or track. PokEYE does not grant you any rights in those third-party marks, artwork, or content. You may not use PokEYE to imply official sponsorship or to reproduce or redistribute third-party card images or data except as allowed by law or the applicable rights holder.
PokEYE itself — including its name, software, design, models, databases, and original content — is owned by us or our licensors.
Subject to these Terms and Apple's terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use PokEYE on Apple-branded products that you own or control, solely for personal collection-management purposes.
You retain ownership of collection data, notes, and photos you provide. You grant us a limited license to host, process, store, transmit, and display that content as needed to operate PokEYE.
If you explicitly opt in to contribute card-scan images or related metadata to improve PokEYE, you grant us a worldwide, non-exclusive, royalty-free license to host, process, analyze, create derived technical data from, and use those contributed materials to improve card recognition and related features. You may disable future contributions at any time in Settings and may request deletion of retained contributed images. Disabling contribution or requesting deletion will not necessarily remove technical learnings, aggregate statistics, or model parameters already created from prior contributions where they cannot reasonably be separated or reversed.

You can stop using the Service at any time and delete your account in the app. We may suspend or terminate access to PokEYE (or any part of it) if we reasonably believe you violated these Terms, created risk for PokEYE or others, infringed third-party rights, attempted to bypass billing or security, or used the Service unlawfully. We may also change or discontinue features over time. Termination of your PokEYE account does not cancel an Apple subscription; you must cancel through Apple.
If you believe content available through PokEYE infringes copyright, email support@pocketeye.app with: identification of the copyrighted work, identification of the allegedly infringing material, your contact information, a statement of good-faith belief, a statement under penalty of perjury that the information is accurate and that you are authorized to act, and your physical or electronic signature. We may remove content and terminate repeat infringers as required by law.
To the extent permitted by law, you will indemnify and hold harmless PokEYE, its owner, service providers, licensors, and affiliates from claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising from your use of PokEYE, your content, your violation of these Terms, your violation of law, your infringement or misuse of third-party rights, or your attempt to bypass billing, security, or access controls. This section does not apply where prohibited by consumer-protection law.
The app license is also subject to Apple's Licensed Application End User License Agreement. Apple is not a party to these Terms, has no obligation to provide maintenance or support for the app, and is not responsible for the Service or for addressing claims relating to it. Apple and its subsidiaries are third-party beneficiaries of the sections of these Terms that apply to Apple and may enforce them against you.
PokEYE is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and quiet enjoyment. Card identification is automated and can be wrong; pricing, collection values, and third-party data may be inaccurate — verify important details yourself. We do not warrant that PokEYE will be uninterrupted, error-free, secure, or compatible with every device or region. Some jurisdictions do not allow certain disclaimers, so some of this section may not apply to you.
To the maximum extent permitted by law, PokEYE and its owner, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits; lost revenue; lost data; loss of goodwill; or substitute services. To the same extent, our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the claim and (b) US $50. These limits do not apply to liability that cannot be limited by law, such as liability for intentional misconduct, gross negligence where not waivable, or consumer rights that cannot be excluded.
We may update PokEYE or these Terms from time to time. If changes materially affect your rights or obligations, we will update the "Last updated" date above and provide notice as required by law — where appropriate, in the app. Continuing to use the Service after changes take effect means you accept the updated Terms, except where law requires a different form of consent.
These Terms are governed by the laws of the United States and, to the extent applicable, the laws of your state or country of residence that cannot be varied by contract. Nothing in these Terms limits any non-waivable consumer-protection rights you have under local law. Before filing a claim, you agree to contact us at support@pocketeye.app and try to resolve the dispute informally for 30 days. Consumers outside the United States may have the right to bring claims in their local courts under non-waivable law.
If any provision of these Terms is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, sale of assets, reorganization, or by operation of law. Sections intended to survive termination — including intellectual property, user-content licenses, disclaimers, limitation of liability, indemnification, disputes, and general terms — survive. These Terms, together with Apple's terms and any posted subscription disclosures, are the entire agreement for PokEYE.
